Last week , hackersreleased a net ton of datastolen from Ashley Madison , andscared the diddlysquat out of cyberspace users everywhere . Now , with an uncanny sense of timing , an appeal motor lodge say the Federal Trade Commission has the power to regulate company ’ cyber security . That ’s just news for you !
A United States appeals courtjust unanimously bear on a lower court rulingthat will let the FTC pursue a lawsuit against Wyndham Hotels for not protecting its client ’s personal financial data . Hackerspulled off a lid trick of breaches back in 2008 and 2009that ultimately extend to the theft of well over half a million Wyndham node ’ credit entry placard data . The FTC ’s rather sensical argument for Wyndham ’s unsuccessful person was that the hospitality troupe “ immoderately and unnecessarily ” exit its customer entropy usable to hack . Wyndham impeach the government of overreaching , but when you step back and think about it , this is exactly why the FTC exists : to protect consumers .
protect consumer data point is evenhandedly new but well precedented territory for the FTC . While the agencyhas a tenacious historyof defending consumers against identity theft and breaches in health information , the progressively frequence of hacks into companies that hive away financial data show that consumer remain at peril . The FTCis considering a case against Target , for instance , over the hack that expose the credit card numbers ofas many as 40 million Target customer . Today ’s appellant motor lodge ruling will leave further precedent for the FTC to take military action , and if Wyndham appealed , the Supreme Court would have to get affect .

Circuit Judge Thomas Ambro called Wyndham ’s argument alarmist , and then he made a laughable — but insightful — gag . “ It invites the tart retort that , were Wyndham a supermarket , leaving so many banana peels all over the situation that 619,000 customers return just propose it should be immune from liability , ” say Ambro . Sounds like a pretty funny supermarket but also pretty dangerous .
The same holds true forcompanies that do n’t protect substance abuser data . It ’s fun for the hacker , sure as shooting . But it ’s inescapably dangerous for any American who entrust these companies to protect their private entropy .
